1. Preliminary Provisions

The Erasmus Tours Kraków online store, available at https://zarezerwuj.pl/erasmus-tours-krakow, is operated by Marta Bomba, conducting business under the name Erasmus Tours Kraków Marta Bomba, located at ul. Racławicka 46/3, 30-017 Kraków, registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the minister responsible for the economy, NIP 6772520731, REGON 540685095.

2. Erasmus Tours Krakow utilizes the services of the Zarezerwuj.pl platform to streamline the booking process for our customers. This reliable and user-friendly system allows students and tourists to easily browse, reserve, and purchase tickets for our tours, ensuring a smooth and efficient booking experience. By partnering with Zarezerwuj.pl, we can offer secure online transactions, real-time availability updates, and a seamless integration of our tour offerings, enhancing the overall customer experience and making it easier for participants to join our exciting excursions.

3. These Terms and Conditions apply to both Consumers and Entrepreneurs using the Store. They define the rules for using the Online Store and the terms and conditions for concluding Distance Sales Agreements with Customers via the Store.

2. Definitions

• Consumer – a natural person who enters into a contract with the Seller via the Store, where the subject of the contract is not directly related to their business or professional activity.

• Seller – Marta Bomba, conducting business under the name Erasmus Tours Kraków Marta Bomba, located at ul. Racławicka 46/3, 30-017 Kraków, registered in the Central Register and Information on Economic Activity (CEIDG), NIP 6772520731, REGON 540685095.

• Customer – any entity making purchases via the Store.

• Entrepreneur – a natural person, legal entity, or organizational unit without legal personality but with legal capacity granted by law, conducting business activity in their own name and using the Store.

• Store – the online store operated by the Seller at https://erasmuskrakow.com/sklep.

• Distance Agreement – a contract concluded with the Customer as part of an organized system for distance contracting (within the Store), without the simultaneous physical presence of the parties, using one or more means of distance communication until the contract is concluded.

• Terms and Conditions – these Terms and Conditions of the Store.

• Order – a Customer’s declaration of intent, submitted via the Order Form, aimed at concluding a Sales Agreement for a Product or Products with the Seller.

• Account – a Customer’s account in the Store, storing the data provided by the Customer and information about their Orders placed in the Store.

• Registration Form – a form available in the Store that allows the creation of an Account.

• Order Form – an interactive form available in the Store that enables placing an Order, particularly by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

• Cart – a feature of the Store’s software in which selected Products for purchase are visible, with the possibility of setting and modifying Order details, including the quantity of products.

• Product – a movable item/service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.

• Sales Agreement – a sales contract for a Product concluded or entered into between the Customer and the Seller via the Online Store. Depending on the nature of the Product, this also includes a contract for the provision of services or a contract for specific work.

• CVV/CVC2 Code – the last three digits located on the back of a payment card. In online purchases, providing the CVV2/CVC2 code is required for cardholder verification.

To use the Store, including browsing the assortment and placing orders, the following are required:

• A standard end device with Internet access and a standard web browser,

• An active email account,

• Enabled cookies.

5. General Information

1. To the fullest extent permitted by law, the Seller is not responsible for disruptions, including interruptions in the operation of the Store, caused by force majeure, unauthorized actions of third parties, or incompatibility of the Store with the Customer’s technical infrastructure.

2. Browsing the Store’s assortment does not require setting up an Account. Placing an order for Products available in the Store’s assortment is possible either after setting up an Account in accordance with § 6 of the Terms and Conditions or by providing the necessary personal and address data to complete the Order without creating an Account.

3. The prices in the Store are displayed in Polish złoty (PLN) and are gross prices (including VAT).

6. Creating an Account in the Store

1. To create an Account in the Store, the Registration Form must be completed with the following necessary details: name and surname, email address, and delivery address.

2. Creating an Account in the Store is free of charge.

3. Logging into the Account is done using the login and password set during registration.

4. The Customer may delete their Account at any time, without providing a reason and without incurring any charges, by sending a request to the Seller via email or in writing to the addresses specified in § 3.

7. Order Placement Rules

To place an Order, the Customer must:

1. Log in to the Store (optional),

2. Select the Product and click the “Add to Cart” button (or equivalent),

3. Log in or choose to place an Order without registration,

4. If ordering without registration, fill in the Order Form with the recipient’s details and delivery address, select the shipping method, and provide invoice details if different from the recipient’s information,

5. Click “Order and Pay” and confirm the order by clicking the link sent in an email (if applicable),

6. Select one of the available payment methods and complete the payment within the specified period, as stated in § 8(3).

8. Complaints and Claims

If you encounter any issues related to your booking or the services provided, you have the right to file a complaint. Complaints must be submitted in writing via email to [email protected] within 14 days of the completion of the service. The complaint should include the booking details, a description of the issue, and any relevant supporting documents.
We will review all complaints and respond within 14 days of receiving the request. If additional clarification is needed, we may contact you for further information. If the complaint is justified, we will offer an appropriate solution, which may include a partial refund, service correction, or an alternative resolution.
Complaints regarding services provided by external partners (e.g., transport companies, accommodation providers, or attractions) will be forwarded to the respective provider. Our company is not responsible for delays, cancellations, or service disruptions caused by third-party providers but will assist in resolving any disputes.

9. Order Processing Time

9.1. All orders are processed within 2 business days from the moment the payment is received.

9.2. For services such as tours, execution follows the schedule provided in the tour description.

10. Delivery Information

10.1. For orders requiring shipment (e.g., tickets, vouchers), delivery is carried out electronically to the email address provided by the customer at the time of ordering.

10.2. In case of any issues with order delivery, please contact us at [email protected].

11. Delays

11.1. The store is not responsible for delays caused by incorrectly provided customer data or reasons beyond the store’s control, such as electronic system failures.

12. Product Availability

12.1. All products and services offered on the website are available based on current stock or reservation limits.

12.2. Availability information is regularly updated. However, in exceptional cases, discrepancies may occur due to simultaneous orders or system update delays.

12.3. If the ordered product or service is unavailable, the customer will be informed immediately, and the seller or service provider will offer:

a) A product or service replacement with another available option

b) An extended processing time, if applicable

c) A refund within a specified number of business days

12.4. The seller or service provider is not responsible for any consequences resulting from the temporary or permanent unavailability of a product or service, as long as the customer is informed in a reasonable time.
12.5    All tours offered are subject to availability based on current reservation limits and capacity.
12.6    The current offer includes five tours: Wieliczka, Energylandia, Ojców National Park, Morskie Oko, and Hike and Thermal Pools.
12.7    Availability is updated in real time on our booking platform. In the event of simultaneous bookings or system update delays, discrepancies may occur.
12.8    If a selected tour is fully booked, the Customer will be informed as soon as possible and offered one of the following options:
a) Changing the booking to another available tour,
b) Extending the waiting period (if applicable),
c) Receiving a full refund within [e.g., 7 business days].
12.9    The Seller/Service Provider is not liable for any consequences resulting from the temporary or permanent unavailability of a tour if the Customer is informed within a reasonable time.

5. Data Retention Period

• Personal data is stored for the duration of the contract.

• After the trip ends, data will be deleted within 30 days (the complaint submission period).

• UNIQA Insurance retains the data for 2 years.

6. Your Rights as a Data Subject

You have the right to:

• Correct (rectify) your data,

• Request deletion (right to be forgotten),

• Restrict processing,

• Object to data processing,

• Request data transfer to another controller.

If you submit a request regarding your personal data, we may ask you some questions to verify your identity.

You also have the right to file a complaint with the President of the Office for Personal Data Protection (PUODO) if you believe your data is being processed unlawfully under GDPR.

Our company utilizes the external booking platform Zarezerwuj.pl to facilitate reservations and payments. When making a booking, customers may be redirected to this platform to complete their reservation and payment process.
All personal and payment data are processed securely and in accordance with applicable data protection regulations. By proceeding with a booking, the customer acknowledges and accepts that the reservation process may involve redirection to an external website
